Welcome to MildBreezeGarden ("we," "us," or "our"). The Terms & Conditions ("Terms") detailed here apply to your use of our yacht charter services and website at mildbreezegarden.rest (the "Service"), which is run by MildBreezeGarden.
You accept these Terms by either booking a charter or using our Service. Access to the Service is not granted if you do not agree with any portion of the terms.
2. Service Overview
MildBreezeGarden provides top-tier yacht charter services, including but not restricted to:
- Single-day yacht charters
- Evening cruises
- Team retreats
- Exclusive events
- Extended charters
All services are provided based on availability and weather permitting. We retain the right to amend or cancel services without prior notice.
3. Booking and Reservations
3.1 Booking Process
When reserving a charter, you must:
- Be 18 years old or older
- Supply precise and complete details
- Make a deposit payment as outlined in your booking confirmation
- Consent to these Terms & Conditions
3.2 Confirmation
A booking is not confirmed until payment has been made and we issue a written confirmation. We may deny service to anyone at our sole discretion.
3.3 Availability
Availability of charters is contingent upon vessel availability and favorable weather conditions. Reasonable attempts will be made to accommodate your requested dates and times.
4. Payment Terms
4.1 Pricing
All pricing is given in £ and is inclusive of relevant taxes unless stated otherwise. Prices can change without notice.
4.2 Payment Schedule
- Deposit: Required payment of 50% of the total cost of charter at the time of booking
- Final payment: Due 48 hours prior to the charter's start time
- Additional fees (if applicable): Due at the end of the charter
4.3 Payment Methods
We welcome payments through various methods including major credit cards, electronic wire transfers, and certified cheques. Payments are processed using secure, encrypted platforms.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- More than 72 hours prior to departure: Full refund, minus transaction fees
- Within 24-72 hours of departure: 50% of payment is refunded
- Less than 24 hours to departure: No refund is provided
5.2 Weather Cancellations
We will propose either to reschedule your charter at no extra cost for the next available slot or provide a full refund if rescheduling is impractical when unsafe weather conditions are decided by our captain.
5.3 Mechanical Failures
Should mechanical issues arise with your assigned vessel, we will strive to supply an appropriate replacement. If an alternate is not obtainable, we will issue a complete refund.
6. Safety and Conduct
6.1 Safety Requirements
All guests must:
- Adhere to all directives from the crew
- Utilize safety equipment when mandated
- Disclose medical conditions that may impact their safety
- Stay within designated areas on the vessel
6.2 Prohibited Items
The items listed below are not allowed on board:
- Containers made of glass
- Illegal substances
- Weapons or firearms
- Excessive amounts of drinks (beyond reasonable quantities for personal consumption)
- Animals (unless given prior permission)
6.3 Conduct
Guests are required to behave respectfully. In the event of conduct that endangers safety or disturbs the charter for others, we reserve the right to conclude the charter prematurely without offering a refund.
7. Liability and Insurance
7.1 Our Liability
Our liability is confined to the paid amount for the charter service. We are not accountable for:
- Injuries sustained by guests due to their own failure to follow safety protocols
- Loss or damage to personal belongings
- Indirect, accidental, or punitive damages
- Delays caused by the climate or unforeseen events beyond our command
7.2 Insurance Coverage
We carry extensive marine insurance that covers our fleet and operations. It is the passenger's responsibility to ensure personal travel and belongings insurance.
7.3 Assumption of Risk
Engaging in our charter services signifies acknowledgment of the intrinsic risks involved in maritime activities and acceptance of personal accountability for your safety and security.
8. Modifications and Itinerary Changes
Changes to itineraries, courses, or schedules may occur due to weather, safety, or operational needs. We will make every effort to provide an experience of equal value.
9. Force Majeure
Our company will not be held responsible for alterations, postponements, or cancellations caused by events outside our control, such as but not limited to:
- Extreme weather
- Natural disasters
- Regulatory edicts
- Port obstructions
- Mechanical malfunctions
10. Privacy and Data Protection
Your private data is processed in line with our Privacy Policy. By utilizing our services, you consent to the collection and use of your information as outlined in our Privacy Policy.
11. Intellectual Property
All materials on our website, such as texts, visuals, logos, and pictures, are protected by copyright and trademark rules. You are not allowed to replicate, disseminate, or produce derivations without our explicit authorization.
12. Governing Law
The laws of United Kingdom govern these Terms, with any legal disputes to be settled in courts located in Southampton, United Kingdom.
